Driving under the influence and driving license confiscated

When you are arrested for drunk driving, the consequences for your private life can be significant. Driving under the influence is considered a criminal offense and can lead to high fines, a license ban and in serious cases even a prison sentence. Driving under the influence often results in the suspension of your driver's license.

Losing your driver’s license has a major impact, especially if you need it for your job or other daily obligations. In this situation, it is crucial to hire a criminal defense attorney who can guide you through the legal process and represent your interests.

What can be the consequences of driving under the influence?

If your driving licence is confiscated, you are temporarily prohibited from driving. Within ten days, you will receive a message from the public prosecutor as to whether your driving licence will be returned or suspended for a longer period. Depending on the seriousness of the situation and any previous offences, the consequences may include:

  • High fines : Fines for driving under the influence can be high, especially for repeated violations.

  • Driving ban : Your driving license may be (temporarily) confiscated, which has major consequences for your mobility and possibly your work.

  • Prison sentence : In serious cases, such as recidivism or an accident, a prison sentence may even be imposed.

How can a criminal lawyer help?

An experienced criminal lawyer can assist you at every stage of the procedure, from the initial arrest to the hearing before the police judge. There are several ways in which a lawyer can support you:

  1. Request for return to the public prosecutor

If you need your driver's license quickly, for example for work, a letter (a petition) can be sent to the public prosecutor asking whether you can temporarily have your driver's license back.

  2. Request for restitution from the court

If the public prosecutor decides that you will not get your driver's license back for the time being, a criminal lawyer can file another letter (a so-called complaint ) with the court. This letter explains why you urgently need your driver's license. Personal interests, such as work or family circumstances, can increase the chances of getting your driver's license back.

  3. Assistance during the hearing

If you are summoned to appear before the police court for driving under the influence, it is important to be well prepared. A criminal lawyer can provide you with legal advice and represent you at the hearing.

Case: Successful defense in a drunk driving case

Recently we helped a client who had been arrested with a high blood alcohol level . Immediately after the arrest we contacted the CVOM to inquire about the decision of the public prosecutor. The public prosecutor had decided to confiscate the driver's license for 10 months.

We then filed a complaint, after which the hearing took place within two weeks at the Utrecht court. During this hearing, the substantive case regarding driving under the influence was also dealt with.

The officer demanded a 10-month driving ban and a large fine. However, our specialized lawyer managed to convince the judge of the client's interests. Within five days, he got his driving license back.
